Workplace accommodation is one of the most complex challenges facing HR professionals today. HR teams are being asked to balance legal obligations, operational realities, and the growing expectations of external bodies such as workers compensation boards, often with little clear guidance, particularly around an employee’s duty to cooperate.
At the same time, managers are increasingly navigating complex mental health-related accommodations. This interactive hybrid presentation moves beyond a high-level legal overview and will provide guidance on the analytical framework to address these complex issues.
Led by Rick Dunlop, an employment and labour lawyer at Stewart McKelvey, the session will work through a series of real-life hypothetical scenarios drawn from situations HR professionals actually encounter. Each scenario will be discussed and worked through live with the audience, giving attendees a practical framework for handling similar situations with confidence.

Real-life hypothetical scenarios that will be discussed and worked through live during the session, with opportunities for attendees to share perspectives and ask questions, illustrating how these issues play out in practice and will provide you with guidance on establishing an analytical framework that will assist you in addressing the following:
- How to make safe and legally sound accommodation decisions in real time, even when the situation is not straightforward
- Where the duty to accommodate ends, and what “undue hardship” means in practice
- What the employee’s duty to cooperate actually requires, and how to rely on it appropriately
- How to communicate clearly with employees, set expectations, and document decisions along the way
- What you can (and should) push back on, and how to do so without exposing the organization to risk
- How to translate accommodation policy into practical steps that managers can apply on the ground
- How to manage WCB-related expectations alongside other accommodation obligations
